Terms and Conditions

The rules for using Majestic Cart, as a customer and as a direct seller.

This document is a draft

It has not been completed or reviewed by a lawyer, and it contains placeholders. It is not in force. 2 sections still need details from the business.

Effective from [DATE]

1. About these terms

These terms are between you and Majestic Cart, which operates Majestic Cart. By registering or placing an order you accept them.

Still needed: legal name; jurisdiction and governing law clause

2. Joining as a direct seller

Required by Consumer Protection (Direct Selling) Rules, 2021 r.5 — No entry fee or compulsory purchase of goods as a condition of joining

Registration is free. We do not charge a joining fee, a registration fee, a renewal fee, or any payment as a condition of becoming a member.

To place your first order there is a minimum order value, set out in the compensation plan. This is a purchase of products you keep, not a fee, and it is not payable unless you choose to order.

You must be 18 or older and resident in India.

Still needed: have a lawyer confirm the minimum first order is structured as a purchase and not an entry fee

3. How income works

Required by Consumer Protection (Direct Selling) Rules, 2021 r.4 and r.7 — Publish the compensation plan; income must derive from product sales, not from recruitment

Income is earned only on products that are sold and delivered. No income is paid for recruiting members, and no income is paid on money added to a wallet.

The current rates, ranks, qualification criteria and payout rules are published in full in the compensation plan available in your account.

We make no representation, promise or guarantee about how much you will earn. Earnings depend on sales you and your team actually make. Most members earn modest amounts, and some earn nothing.

Still needed: link the published compensation plan; publish an income disclosure statement based on actual member earnings

4. Your wallet

The shopping wallet holds money you have added to buy products. It cannot be withdrawn as cash and is not a deposit, a savings product or an investment. It earns no interest.

Money is added only after we verify your payment against our bank statement. If the payment cannot be matched, the request is rejected and you are told why.

The income wallet holds commission you have earned and can be withdrawn subject to the minimum, the deduction and any qualification conditions set out in the compensation plan.

Still needed: confirm with your accountant how wallet balances are treated for GST and accounting

5. Orders and pricing

Required by Consumer Protection (E-Commerce) Rules, 2020 r.5 — Display total price with a breakdown, and the country of origin of goods

Prices shown include GST. The breakdown appears at checkout and on your invoice.

Country of origin is shown on every product page.

We may decline or cancel an order where a product is out of stock, where a price has been listed in error, or where we suspect fraud. If we cancel, the full amount goes back to your wallet.

Still needed: add country of origin to every product record

6. What members may not do

Required by Consumer Protection (Direct Selling) Rules, 2021 r.7 — Prohibit misrepresentation by direct sellers

As a member representing this business you must not:

  • promise or suggest any specific level of income to anyone
  • describe joining as an investment, a scheme, or a way to earn without selling
  • make claims about our products beyond what appears on the product page
  • create more than one account, or register an account in someone else's name
  • buy products purely to qualify for income rather than to use or sell them

7. Suspension and closure

We may suspend or close an account that breaches these terms, that we reasonably suspect of fraud, or where required by law. We will tell you why.

You may close your account at any time. Any verified wallet balance you are entitled to will be settled in line with the refund and payout policies.

Still needed: define exactly what happens to each wallet on closure — this needs legal input

8. Our liability

This site is built and maintained by Cre8nex, a technology services provider engaged by Majestic Cart to develop and operate it to the specifications and instructions given by its owners. Cre8nex holds no ownership interest in Majestic Cart, does not determine the products sold, the compensation plan, or any other business or commercial decision reflected on this site, and is not liable for their operation or outcome.

[TO BE DRAFTED BY COUNSEL — remaining limitation of liability, indemnity, force majeure.]

Still needed: drafted by a lawyer

9. Complaints and disputes

Required by Consumer Protection (E-Commerce) Rules, 2020 r.4(5) — Name a grievance officer and publish a resolution timeline

Contact Bijoy Saha at grievance@majesticcart.in. We acknowledge within 48 hours and aim to resolve within one month.

Nothing in these terms limits your rights under the Consumer Protection Act, 2019.

Still needed: governing law and jurisdiction clause
